Legal Document Versioning
Maintain clear version history, effective dates, and legally sound update procedures whenever Terms of Service, Privacy Notices, DPAs, or Cookie Policies are introduced or revised.
Versioning & Update Governance
- Explicit Version Metadata:
- Every legal document must carry clear metadata at the top and in system records:
- Document title & version identifier (e.g.,
v1.2or2026-10-20). - Publication / notice date and Effective date (including transitional rules where existing customers become subject to updated terms on a later date than new sign-ups).
- Link or reference to prior archived versions so users and auditors can inspect historical terms.
- Document title & version identifier (e.g.,
- Every legal document must carry clear metadata at the top and in system records:
- Classify the Nature of Each Change:
- Editorial / typographical clarifications: Formatting improvements, updated contact details, or clarifications that do not alter rights, obligations, or data processing.
- Operational / non-material updates: Adding a functionally equivalent feature or updating descriptive details within existing scope.
- Material contractual changes: Changes to pricing, billing cycles, renewal/cancellation rules, liability allocations, governing law, or core service scope.
- Material privacy / subprocessor changes: New processing purposes, new categories of personal data, new third-country transfers, or new subprocessors under an Art. 28 DPA.
- Match Update Mechanics to Legal Requirements:
- Terms of Service updates: Verify that amendment clauses specify valid reasons for unilateral changes, provide required advance notice on a durable medium (e.g., email + in-app banner), and grant consumers a clear right to terminate before the changes take effect where required by consumer law.
- Privacy Notice updates: Provide advance or timely notice of material processing changes under GDPR Arts. 12–14; where a new activity relies on consent, trigger a fresh, unbundled opt-in flow rather than relying on passive notice.
- DPA Subprocessor updates: Honor the advance written notification window and customer objection procedure committed in the Art. 28 DPA before routing customer data to a new subprocessor.
- Auditability of Acceptance & Notice:
- Check that the database records which document version number/hash and timestamp a user accepted or was notified of at sign-up, checkout, or re-consent.
